What the City's code requires
The City's Code of Ordinances makes it unlawful to "start construction on a new building, remodel or alter an existing building," install a swimming pool or a fence, or do any electrical, plumbing or mechanical work on a structure without first obtaining a permit. Its flat fee for each swimming pool permit is $80.00, and that fee "includes a rough-in inspection of the steel, electrical, bonding and plumbing and then a final inspection of the electrical system and security fencing." The code doesn't say in its own words whether remodeling an existing pool falls under the pool permit, so ask the City's Building and Code Enforcement office before work is scheduled. Which pool code covers a remodel
Texas law says that in a city that elects to regulate pools, the International Swimming Pool and Spa Code governs every kind of pool and spa work there, from new construction and alteration to remodeling, enlargement and repair, and that state law wins where a city's code conflicts with it on pool operation, water quality, non-construction safety standards, signage or enclosures. The 2021 edition of that code has a chapter covering new construction, modification and repair of inground residential pools, including pools partly or entirely above grade. It allows minor additions, alterations, renovations and repairs in the same manner and arrangement as the existing system, provided they aren't hazardous and are approved, and it sends pool electrical work to NFPA 70 (the National Electrical Code) or the International Residential Code, and water service, makeup and drainage piping to the International Plumbing Code. Which edition the City enforces is a question for its building office.

The City's own Public Utilities Department publishes its drought contingency plan, and the plan names pools at two levels. Under Stage 2, swimming pools, wading pools and jacuzzi-type pools, indoors or out, may be filled, refilled or topped up only on designated watering days, from midnight to 10:00 a.m. and from 8:00 p.m. to midnight. A higher stage removes even those hours: "The filling, refilling, or adding of water to swimming pools, wading pools, and jacuzzi-type pools is prohibited." A remodel that replaces the interior finish ends with a full refill, so check the City's current stage before the pool is drained.

The 1970 vote and the growth that followed
The city takes its name from the James E. Morgan family, who owned much of the land where it was built. Developers bought 1,277 acres for the project, and at the end of June 1970 residents voted to incorporate with an aldermanic form of government; the City dates its incorporation to July 1, 1970, and today runs under a council-manager form of government. A business district of service industries grew up to serve residents and Belton Lake visitors, most workers commuted to Temple or Belton or worked at Fort Hood, and children went to school in the Belton Independent School District. By 1990, when residents voted to change to a city-manager style of government, the population was about 1,766.
The marina and the 1997 tornado
The Morgan's Point Resort Marina sits at the end of Calamity Jane Drive. A tornado destroyed it in May 1997, and Marine Development Inc. was hired to rebuild it. It has a high-water walkway that keeps boats reachable when the lake rises far enough to close the parking-lot gates, and it belongs to the Marina Association of Texas. Does an above-ground pool need a fence in Morgan's Point Resort?
Yes, once it's deeper than 14 inches. The City requires every outdoor swimming pool of permanent or semi-permanent construction "having a depth of more than 14 inches, whether constructed above or below the ground," to be enclosed by a fence built to Appendix B, Section B105, of the International One and Two Family Dwelling Code, 2000 edition, and it makes owning or possessing an unfenced pool unlawful. Its zoning ordinance lists private swimming pools, including those in recreation or community areas, among its uses. Texas law also stops a property owners association from banning or restricting a pool enclosure that conforms to state or local safety requirements, when it is designed not to be climbable, stands no more than six feet tall and is made of transparent mesh or clear panels set in metal frames.
Who runs the water system in Morgan's Point Resort?

Its Public Utilities Department manages water service and billing, maintains the water lines and pumps, carries out drinking water quality testing and compliance reporting, and publishes the City's Annual Drinking Water Report and drought plan.
