Which pools the state rules cover
The state's public-pool rules leave out residential pools, which DSHS defines as pools on private property for no more than two resident families and their guests. Class B pools are open to the general public, with or without a fee; Class C pools serve occupants, members or students and their guests and are run with hotels, apartments, condominiums, RV and mobile home parks, property owner associations, clubs or schools. The federal Virginia Graeme Baker Act also counts a pool open only to an apartment complex's residents as a public pool, and the Texas pool-yard enclosure law, Health and Safety Code Chapter 757, covers pools owned or run by multiunit rental complexes and property owners associations.
The code editions behind the work
DSHS adopts the 2021 International Swimming Pool and Spa Code for the construction, alteration, renovation, enlargement and repair of commercial pools, while the City of Killeen has adopted the 2024 edition. For existing commercial pools, state law lets minor additions, alterations, renovations and repairs be done in the same manner the pool was originally authorized, and a pool that complied on August 31, 2021 may be repaired under the law that applied that day. DSHS may also review plans for a public pool, and tells the owner in writing if it intends to.
Who inspects a public pool in Bell County
A Texas city or county may require a permit to operate a public pool, inspect it, charge a reasonable fee and close it for violations. DSHS doesn't investigate public pool complaints where a local health department exists, and sends people to the city or county first. Killeen is a member of the Bell County Public Health District, whose environmental health page lists vector control, septic systems and retail food but names no pool program, so ask the City and the district which office covers a given pool.

Light-colored finishes
Public-pool finishes have to be white or light. The 2024 International Swimming Pool and Spa Code, Killeen's adopted edition, sets at least 8.0 on the Munsell gray scale for floors and walls, up from 6.5 on the Munsell color value scale in the 2021 edition that Texas adopts; residential pools are exempt. The 2021 code's exceptions include competitive lane markings, step and bench edge markings, waterline tiles and pools shallower than 24 inches. The CDC's Model Aquatic Health Code gives the reason: from the deck, a swimmer on the floor should be visible, and algae, debris, cracks in the finish and the reference tiles easy to spot.
Slip resistance
Under the code, surfaces inside a public pool or spa that people stand on must be slip resistant and must not cause injury in normal use. The 2021 edition also requires deck walking surfaces within 4 feet of a public pool or spa to be slip resistant.
The deep-end tile line and step edges
Where a Class B or C pool deeper than 5 feet changes from shallow to deep, Texas requires a row of floor tile at least 4 inches wide, or another permanent marking, in a color that contrasts with the pool bottom; the CDC's model code asks for a contrasting line 2 to 6 inches wide that runs up the walls to the waterline. The code also wants the leading edges of public-pool stair treads outlined with slip-resistant contrasting tile or another permanent marking 1 to 2 inches wide.
Depth markers and no-diving signs
In Texas, depth markers go within the top 4-1/2 inches of the wall, directly below the coping where they can be read from the water, with at least two per pool whatever its size. They must be permanent, with numbers and letters at least 4 inches tall in a contrasting color, spaced no more than 25 feet apart, and show units as feet and inches or FT and IN. Where a no-diving marker is required, it is at least 4 inches tall, shows a diver's profile in a circle with a 45-degree slash and sits within 18 inches of the water's edge.

Drain covers and the VGB Act
Signed on December 19, 2007 and in force from December 19, 2008, the Virginia Graeme Baker Pool and Spa Safety Act is federal law. It requires anti-entrapment drain covers on every public pool and spa, and a pool with a single main drain that isn't unblockable needs a backup such as a safety vacuum release system, a suction-limiting vent, gravity drainage, an automatic pump shut-off or drain disablement. The Consumer Product Safety Commission's rule ties drain covers to the ANSI/APSP/ICC-16 2017 standard, and the Commission recommends replacing covers past the expiration date marked on them. Under Texas rules, a public pool's pump must not run with a drain grate or cover missing, broken or loose.
Closing the pool yard
While a public pool is closed for renovation, Texas requires users and other unauthorized people to be kept out of the pool yard and a closed sign on the entry gates, and the closed pool must not give off odors, breed insects or create other hazards. A pool-yard gate may be propped open only while the owner's agent, employee or contractor is present doing work that needs it open, and a pool whose water drops below the operating range of its skimmer or gutter system must close.
Draining and refilling a public pool in Killeen
State rules say a public pool's drain water is disposed of under TCEQ or local rules, never hard-plumbed to a sewer or septic system, discharged through an air gap at least two pipe diameters above the overflow level, and treated to neutralize chemicals above discharge limits. Killeen's stormwater ordinance accepts pool water only once it is below 0.10 mg/l total residual chlorine. National HOA reserve figures reported in 2026 give standard white plaster 8 to 12 years on a community pool, upgraded quartz 10 to 15 and pebble 15 to 20, with the upgrades costing 30% to 60% more per job. State chemistry targets that protect the finish
Texas sets public-pool chemistry in a table of minimum, ideal and maximum values: free chlorine 1.0, 2.0 to 3.0 and 8.0 ppm; pH 7.0, 7.2 to 7.6 and 7.8; total alkalinity 60, 60 to 180 and 180 ppm; and calcium hardness 150, 150 to 400 and 1,000 ppm. The water has to be kept chemically balanced and checked with a method such as the Langelier Saturation Index at least once every 10 days while the pool is open, with the results logged, and every Class A, B and C pool runs under a trained, certified operator.
Apartment and HOA pool enclosures
Under Chapter 757, an apartment or HOA pool enclosure is at least 48 inches high with no gap a 4-inch sphere can pass, and its gates self-close, self-latch, lock and open outward, with the latch at least 60 inches up (42 inches where the gate opens only by key, card or combination on both sides). Is sales tax charged on commercial pool resurfacing in Texas?
It depends on whose property it is. Under the Texas Comptroller's rules, labor to repair, remodel or restore residential property isn't taxable, and for sales tax, a pool that a homeowners association or an apartment complex owns for its residents counts as residential; work on nonresidential property, such as a hotel pool, is taxable on the total charge. Does resurfacing a pool trigger the ADA pool-lift rules?
The Department of Justice doesn't say.
